HMRC has significantly ramped up its focus on cryptoassets. Under new international data-sharing frameworks, UK exchanges are now required to report customer transaction data directly to HMRC, which is matching this against Self Assessment returns and issuing nudge letters - and formal enquiries - at scale.

What HMRC already knows

  • Full transaction history from Coinbase, Kraken, Binance UK, and other FCA-registered UK exchanges - including deposit amounts, withdrawals, and trade history.
  • Bank transaction data from the financial intelligence unit, matching fiat deposits to exchange activity.
  • International data under the Crypto-Asset Reporting Framework (CARF), which goes live from 2027 across 50+ countries - meaning overseas exchange data will also flow to HMRC.
  • NFT disposals, DeFi income, and staking rewards - HMRC's guidance (issued 2022 and updated since) treats all of these as taxable events.

The fundamental tax rules

Cryptoassets are treated as capital assets for UK tax purposes - not as currency and not as gambling winnings (a common misconception). This means:

  • Every disposal - whether selling for fiat, swapping one crypto for another, or spending crypto on goods - is a taxable event for CGT purposes.
  • The cost basis uses a specific identification methodology: same-day rule, then 30-day rule, then Section 104 pool average cost.
  • Mining income, staking rewards, and airdrops are generally treated as income at the date of receipt - subject to income tax and NIC (if received in a trading capacity).
  • Hard forks that result in new coins are generally treated as having a nil acquisition cost.

The complex rules you must get right

Section 104 Pooling

All coins of the same type are pooled into a single holding and an average cost per coin is maintained. Every acquisition changes the pool cost; every disposal uses the average cost. This must be recalculated chronologically across your entire transaction history - and it compounds quickly with active trading.

Same-Day and 30-Day Rules

If you sell crypto and then buy the same crypto on the same day, the sale is matched against the same-day purchase (not your pool). Similarly, purchases within 30 days after a sale are matched before the pool. These rules prevent artificial loss harvesting by "bed and breakfasting" - selling to crystallise a loss and immediately rebuying. Ignoring these rules is one of the most common calculation errors in crypto tax returns.

DeFi & Staking Income

Staking rewards are generally treated as miscellaneous income at the date of receipt and valued at the market price on that day. When those staked tokens are later disposed of, CGT applies on the gain above the income value that was previously taxed. Many DeFi participants are therefore facing double taxation compliance obligations they are entirely unaware of.

Liquidity Pool Tokens and Wrapped Assets

HMRC's position on DeFi lending and liquidity provision has evolved. Depositing assets into a liquidity pool in exchange for LP tokens is now generally treated as a disposal for CGT purposes at the time of deposit - not when you withdraw. This creates tax events that many investors have not reported.

Record-keeping requirements

HMRC expects you to retain records of every transaction for at least five years after the Self Assessment filing deadline. This includes: date of each transaction, type of cryptocurrency, number of tokens, value in GBP at the time of transaction, costs and fees, and the pool cost at each point. Exchange records alone are often insufficient - particularly for DeFi activity, cross-chain transfers, and transactions on non-UK exchanges.

Specialist crypto tax software (Koinly, CoinTracker, TokenTax) can ingest data from hundreds of exchanges and wallets and generate an HMRC-compliant tax calculation. This is not a luxury for active traders - it is the only practical way to maintain accurate records at scale.

Voluntary disclosure vs. waiting

HMRC's penalty framework for under-declared tax ranges from 0% to 200% of the tax owed, depending on whether the behaviour was careless, deliberate, or deliberate and concealed, and whether the disclosure was prompted or unprompted. An unprompted voluntary disclosure - coming forward before HMRC contacts you - attracts the lowest penalties. Once HMRC issues a nudge letter, the window for an "unprompted" disclosure closes.

Get Compliant Before HMRC Comes to You

Voluntary disclosure carries significantly lower penalties. We use specialist crypto tax software to reconstruct your full history, calculate your position accurately, and manage the disclosure process.
